The sentencing phase of a high-profile murder trial in Miami Beach concluded Wednesday as the judge prepared to decide the fate of the defendant. Tamarius Davis, 27, has been held in custody since pleading guilty to the fatal shooting of a visitor in 2021. The court heard final arguments from both sides on the third day of proceedings.

The state is requesting a life sentence for Davis, who admitted to second-degree murder. Prosecutors argue that the severity of the crime demands the maximum penalty. Defense attorneys are asking for a term of no more than 25 years, citing the defendant's mental state at the time of the attack.

The incident occurred at La Cerveceria on Ocean Drive, where Dustin Wakefield, 21, was eating with his family. Witnesses said Davis pointed a gun at Wakefield's one-year-old son. Wakefield was shot in front of his wife and child after pleading for his son's safety. Prosecutor Casey Hughes noted that Davis fired five shots at Wakefield.

Hughes told the court that the Wakefield family has already accepted a permanent loss. He stated that the family will mourn their son for the rest of their lives. He asked the judge to give Davis the same punishment he believes the family deserves.

Davis appeared in an orange jumpsuit and shackles during the hearing. His lawyer, Juan Mourin, argued that Davis had taken psychedelic mushrooms before the shooting and was unaware of his actions. Mourin clarified that the defense was not offering an excuse but rather context for the defendant's behavior. He described Davis as remorseful and fully responsible for his actions.

Lora Wakefield, the victim's mother, addressed the court before the final arguments. She said she had forgiven Davis on the first day of the hearing. She emphasized the need for consequences to deter future violence. She stated that the world needs to see that choices lead to results. She expressed hope that others could find a way to heal.

The judge indicated she has substantial factors to weigh before issuing a verdict. She is scheduled to announce the sentence on Thursday morning. Davis will remain in custody until the judge delivers her decision.
